GoGetta – Terms of Service
Effective: November 3, 2025
Kia ora, and thanks for visiting GoGetta ("GoGetta," "we," "us").
These Terms of Service ("Terms") govern your use of gogetta.com (the "Site") and all services we provide (the "Service"). "You" refers to any business, organisation, or individual using our Site or Services.
By using our Site or purchasing any Service, you agree to these Terms and our Privacy Policy. If you don't agree, please don't use the Site or Service.
1. What We Do
GoGetta provides recruitment marketing, employer branding, creative campaigns, and proactive talent sourcing services.
We deliver and manage all campaign activity — clients do not have self-serve access to post or manage job ads on gogetta.com.
2. Accounts
Some features may require an account. You agree to provide accurate details and keep them current. You are responsible for protecting your password and account activity.
If you believe your account has been compromised, contact support@gogetta.com immediately.
3. Fees, Quotes & Payment (Clients)
Service fees are outlined in your proposal, quote, or Statement of Work (SOW). All prices are in NZD and exclude GST unless stated otherwise.
- External media (digital, social, outdoor, print, broadcast) is quoted first and requires your written approval before booking.
- Once approved, full payment of the quoted media cost is required before production or placement.
- Once booked, media costs are non-refundable, even if creative or timing changes occur.
- Invoices are payable on acceptance unless your SOW specifies otherwise.
- Late payment may result in suspension of services and incur interest or recovery costs.
- Promotional pricing for other clients doesn't apply unless confirmed in writing.
4. Ownership & Intellectual Property
You retain ownership of your brand assets and information supplied to us ("Client Content").
- GoGetta owns its creative processes, templates, and working files.
- After full payment, you receive a non-exclusive, worldwide licence to use final deliverables for recruitment and employer branding.
- Working files and raw creative remain GoGetta property unless otherwise agreed in writing.
5. Client Content, Approvals & Compliance
You grant GoGetta permission to use your materials solely for the purpose of delivering the agreed Service.
- You are responsible for reviewing and approving all creative, targeting, and campaign materials before launch.
- You are responsible for ensuring all approved content complies with applicable laws, including the Fair Trading Act 1986, Privacy Act 2020, and Human Rights Act 1993.
6. Third-Party Platforms
GoGetta may use third-party platforms and suppliers (e.g. Meta, Google, Spotify, or outdoor media vendors) to deliver campaigns.
- You authorise us to act on your behalf to manage these placements.
- GoGetta is not responsible for the uptime, performance, or policies of third-party platforms.
7. Prohibited Conduct
You must not use the Site or Service to:
- Break the law or infringe intellectual property or privacy rights
- Upload false, misleading, or harmful material
- Introduce malware or automated data scraping tools
- Impersonate others or misrepresent your affiliation
- Interfere with or damage the Site or its security systems
8. Indemnity
You agree to indemnify GoGetta, its directors, employees, and contractors against any losses or claims resulting from:
- Your breach of these Terms or applicable law
- Your supplied or approved content
- Misuse of the Site or Service
9. Disclaimers
The Site and Service are provided "as is" and "as available."
- GoGetta makes no warranties regarding uptime, error-free operation, or outcomes beyond our control.
- We're not responsible for platform outages, third-party changes, or errors in client-approved materials.
10. Limitation of Liability
To the fullest extent permitted by law:
- GoGetta is not liable for indirect or consequential loss (e.g. profit, opportunity, goodwill).
- Our total liability in any 12-month period is capped at the greater of (a) the total amount you paid to GoGetta during that period or (b) NZD $100.
11. Data, Privacy & Security
You own your data. You grant GoGetta permission to process it solely to deliver your Service.
- We apply commercially reasonable security measures to protect client and candidate data.
- We may use aggregated, de-identified data for analytics and service improvement — never in a way that identifies you personally.

12. Ending Services
Either party may end a Service by written notice.
- If you end a Service after work has begun, you must pay for:
- Work completed to date, and
- Any external media booked or committed (which remain non-refundable).
- GoGetta may suspend or terminate services for non-payment or breach of these Terms.
13. Candidates – Applying & Uploading CVs
This section applies to anyone ("Candidate") who submits details, applies for a role, or uploads a CV via gogetta.com or a GoGetta-managed campaign.
13.1 No fees to apply
Applying through GoGetta is free. We will never ask you to pay to apply for a role.
13.2 Information you provide
By submitting your CV or details, you confirm:
- The information is accurate and your own;
- You consent to GoGetta collecting, storing, and using your information to assess your suitability and to share it with the relevant hiring company or client;
- You consent to us contacting you about your application and similar roles (you can opt out anytime).
13.3 How we use your information
We use your data to assess fit, shortlist candidates, and communicate with you. We may conduct reference or background checks with your consent and in line with applicable law.
13.4 Sharing with clients
We may share your information with the specific employer or client recruiting for a role. We do not sell candidate data. Employers are required to handle candidate information in line with privacy law.
13.5 Access, updates, and deletion
You can request access to, correction of, or deletion of your information under the Privacy Act 2020 by contacting privacy@gogetta.com. We'll respond within a reasonable timeframe.
13.6 No guarantee of employment
Submitting a CV does not guarantee employment, interviews, or job offers. Hiring decisions are made by the employer, not GoGetta.
13.7 Candidate conduct
Do not submit false information, someone else's CV, or unlawful content. Do not upload malware or attempt to interfere with the Site.
14. Changes to These Terms
We may update these Terms at any time. If a change materially affects your rights, we'll post notice on the Site before it takes effect.
15. General
These Terms, along with any proposal, SOW, or Privacy Policy you agree to, form the full agreement between you and GoGetta.
- You may not transfer these Terms without our written consent.
- If any part is found invalid, the rest remains effective.
- These Terms are governed by New Zealand law, and you submit to the exclusive jurisdiction of NZ courts.
- By using the Site, you consent to receiving communications from us electronically.
